Human Rights Activist and Pro-Chancellor and Chairman of the Governing Council for Adekunle Ajasin University, Akungba-Akoko, Dr. Tunji Abayomi has cautioned the Leadership of All Progressives Congress (APC) over the congresses scheduled to hold across the country on Saturday saying they should exercise restraint before dabbling into what may result into a collosal electoral doom for the party in coming elections.
Abayomi while speaking with newsmen in Akure, the Ondo state capital hinged his warning on the recent Supreme Court Judgement between PDP Governorship Candidate, Mr. Eyitayo Jegede SAN and Governor Oluwarotimi Akeredolu SAN
On this, he expressed worry on the lingering controversies tailing the credibility of the Governor Buni led National Caretaker Committee of the APC, to conduct foolproof elections.
His words: ” Festus Kayemo SAN is right in his view because a Governor cannot hold Executive position, and at the same time do an executive duties, and cannot receive renumeration arising from executive duties, in other words, holding the two positions together will amount to unconstitutionality.
“So, therefore if we go to the Congress, any action taken by Governor Buni Executive will be illegal and can’t validated and cannot be valid. That is implication of the comment and the points Festus Fayemo is driving at.
“In other words, it will be dangerous for APC to stand on the shoulder of unonstitutionality and expect legitimate order.
“The best thing in a democratic setting, is for the Congress to be suspended and the Chairman who is a Governor to resign, and I will advise him to resign while a new Chairman of the Party should be appointed through an independent decision.
“That is the best solution to the problem because all the foundation and actions of Governor Buni executive can invalidated through a constitutional challenge.
“You cannot build something on nothing. You cannot build political decision on unconstitutionality and expect it to stand. That is also the position of the Court of Appeal.
He therefore congratulated Governor Oluwarotimi Akeredolu for escaping the problem he did not recreate.
